I. General Information
WholeSwitch offer the Services for your personal use in accordance with these terms and conditions of service, which make up the legally binding agreement between you and WholeSwitch governing your use of the Services. Users should abide by all of this terms and conditions.
Definitions:
(a) "Your Account" means the user account that you create with WholeSwitch which permits you to use
the Services;
(b) "Agreement" means the terms and conditions set out in this document together with the WholeSwitch Privacy;
(c) "WholeSwitch" is owned by WholeSwitch Telecom Holdings Ltd.;
(d) "Services" means WholeSwitch's PC2phone Service, Mobile VOIP Service, Call Back Service, Calling Card Service, Call Shop Service, I-PBX Services, DID Numbers, SMS Service, Wholesale Voice service and Data Center Service and any of the datas, tools, applications, and services.
WholeSwitch reserves the right to modify this document. The modified Agreement will be effective within 30 days of publishing the amended Agreement on this website. This ducument is committed to laws and regulations in Hongkong.
II. REQUIREMENT TO USER
All the user must meet the following conditions:
(1) You must be at least 18 years old;
(2) You must be committed to our FairUse Policy;
(3) You must accept and abide by the terms and conditions.
III. RESTRICTIONS ON USE A. EMERGENCY CALLS-911 Dialing
Our services are not a substitution for primary traditional telephone. For technical reasons, for example, the network congestion will probable delay your emergency call or the 911 dispatcher can not capture your location information for network quality reason.
WholeSwitch strongly recommends that you consider alternate means for making emergency 911 calls. B. Personal Use Only
WholeSwitch offer the Services for individual use only. Commercial uses are forbidden and cause immediate termination of Your Account. Also, You agree that you shall not charge any third party for use of the Services, and you are forbidden to request any third party service provider to charge a third party for use of the Services. Also, you must agree not to send spam by our service.
C. Your Responsibilities and Content
Your use of the Services should be committed to all applicable local, state, national and international laws and regulations. Besides, you should completely responsible for the contents of your transmissions through the Services.
Ⅳ. FAIR USE POLICY A. Whoch US & Canada Plan Whoch US & Canada Plan have a maximum call duration of 4 hours per call, after which time the call will be ended. Whoch US & Canada Plan is subject to a limitation of 2000 minutes during each monthly billing cycle for outgoing calls to Canada, the US and Puerto Rico.
B. Whoch World Plan Whoch World Plan have a maximum call duration of 4 hours per call, after which time the call will be ended. Whoch World Plan is subject to a limitation of 2000 minutes during each monthly billing cycle for outgoing calls to international countries specified in Whoch World Plan.
V. PROPERTY RIGHTS
WholeSwitch is a registered trademark of wholeSwitch Telecom Holdings Ltd.The Services are owned and operated by WholeSwitch. WholeSwitch is the owners of all intellectual property rights in the Services. The Ownership of WholeSwitch Numbers is vested solely in WholeSwitch Telecom Holdings Ltd..
